External v Internal Investigations

When bullying or sexual harassment allegations are made, it is sometimes easily to jump straight to undertaking an internal investigation’ so as not to involve anyone more than needed. The benefits to engaging an external consultant have substantial benefits, an external investigation and review into the matter, ensure there is no impression of bias or unfairness to either party.

External investigations give the organisation the advantages of:
• Maintaining integrity, fairness
• Obtaining outside experience and without bias
• Instils trust in the process undertaken by all involved

Those involved in incidents that have been investigated independently are likely to feel heard and supported, with the assistance of an external consultant the organisation can proceed to resolution and next steps confidently.

HR and Payroll Audits

Recently amid the Royal Commissions into Banking and Aged Care, a number of established organisations have been highlighted for underpaying workers, such as ABC, Rockpool Restaurants and previously Lush Cosmetics.

This just shows that even large established organisations cannot assume payroll compliance and not fall foul to system issues.

The ABC has admitted it underpaying up to 2500 casual staff over the past six years and has commenced an urgent review in conjunction with the Fair Work Ombudsman and unions. The ABC have acknowledged problems with systems and compliance errors and is currently working with Fair Work and the unions to review.

Compliance complacency can be easily overcome with an independent review and audit to confirm how penalties, allowances and loadings should be calculated and applied. A thorough review in the long run saves organisations time, money and reputational damage.
